SCOTUS and the Dangers Ahead
On March 26, the Supreme Court heard arguments about restricting access to the abortion pill mifepristone. The case is part of the sustained attack on women’s right to an abortion. But it is much more than that.
The media tells us that the antiabortion movement is composed of religious “fanatics”. While many of the movement’s foot soldiers are indeed motivated by religious beliefs, pro-fascist forces are the power behind it. Not because they care for “unborn children”, but because they can use the antiabortion movement to attack what is left of our democracy and social justice.
This is no secret. It is laid out in the Heritage Foundation’s fascist playbook, Project 2025.* This battle plan lays out how to destroy government at every level and how to abolish public health, public schools, corporate accountability, and our ability to protect the environment.
A key goal of Project 2025, is to abolish government powers to regulate corporations. The real target of the attack on mifepristone was the ability of the FDA to control the distribution of the drug, and indeed on its ability to regulate any drug.
The media has told us to relax, SCOTUS is going to throw out the case on a technicality and all is well. But this is not the time to celebrate a potential victory. the fascists only lost a small battle, and a more important fight is already underway.
On January 17, SCOTUS heard arguments on a case that will determine the fate of the Chevron deference. This is a little known principle of administrative law that permits the FDA, EPA, CDC, and other government agencies to regulate using science, not corporate need.** The fascists, including lawyers from Koch’s Americans for Prosperity, are trying to eliminate the Chevron deference, taking another step in making Project 2025 a reality. If they succeed, the antiabortionists will be able to ban the distribution, indeed the sale, of mifepristone.
The battle is now joined. The fascists intend to win, but we can stop them. We are the future and what we do will determine the fate of America and the world. Now is the time to unite in the struggle for justice, equality, and peace.
