FROM RULE OF LAW TO RULE OF FEAR

“The Court decided to throw out the Constitution. Why?”

The Supreme Court decided to throw out the Constitution by ruling that Donald Trump can be on the ballot in Colorado. The state of Colorado banned Trump from the ballot after he stated that he would “suspend the Constitution” and “be a dictator on day one.” Colorado relied on specific Constitutional language which is quite clear. Article 3 of the 14th Amendment forbids government officials from being on the ballot after they engaged in insurrection.

The Supreme Court’s decision is supposedly conceding to demands that the American people should decide who is President, not the Court. This is completely opposite to their ruling against abortion, for example, which is supported by over 70% of the American people.

This decision is not surprising. The Supreme Court is an arm of the US government, and, thereby, a tool of the Capitalists that rule this country.

• When slave capital was powerful the Dred Scott Decision supported slavery.
• After World War II, the growth of finance capital required a more liberal society, which was aided by rulings supporting integration, abortion rights, gay marriage, and expanded voting rights.
• Now, capitalism is dying and the capitalists need a repressive, fascist society that attacks democracy supported by court rulings allowing the open sale of the government to corporations, restricting voting and abortion rights, and, now, protecting the leading fascist politician.

In defense of this decision, corporate Democrats floated the notion that Republicans might ban Biden from the ballot. This fear is completely fabricated and has never even been attempted. Their conclusion is that we should worry so much about what the “bad guys” might do that the law and the Constitution must be rejected. This is the rule of fear replacing the rule of law.

The news media tells us that the recent anti-democratic decisions by the Supreme Court are due to the Republican “super majority”. Vote for the Democrats and all will be well.

We have seen this game over and over: the fascists push the envelope and the corporate Democrats, in defiance of their own party, collaborate and conciliate to give the fascists 80% of what they want. They tell us that there is no way we can alter this system, but they immediately alter it to strengthen the corporate dictatorship they intend to establish.

The solution is really quite clear: Whomever controls the government controls the Supreme Court. The way forward is to build a political alternative based on working-class unity. We demand peace and prosperity. We demand life, liberty, the pursuit of happiness, fresh air, clean water, jobs, healthcare, housing, and education.

We demand the rule of law, not the rule of fear.
